A solid contract with an earnest money deposit shows a seller that you have both the resources and the desire to close the deal. You’ll typically use a third-party escrow agent such as the title company, to hold your earnest money deposit in an escrow account. You should avoid giving the deposit to the seller directly. The terms of the contract decide where earnest money lands if the contract is broken. What are Typical Contract Contingencies?

  1. My realtor is telling me that I should make a larger earnest money deposit than I wanted to. I don’t want to lose the house, and I do have the larger amount of money that she is suggesting to put down..but I have heard some horror stories of sellers not returning the money if something happens.

    Yes, your agent can give you guidance about how much to offer. Remember, though, that the agent has two different incentives to inflate the price. First, the higher the sales price, the more commission they make. Second, the more you offer, the more likely the seller will accept your offer, and the agent wants the house to be sold so she can collect her commission. Although you should keep these things in mind, most agents I’ve known have suggested to offer a bit less than the seller was asking.
